CCAA Watch List

Because of OCUFA’s advocacy and your pressure, the federal Liberal government is taking an important step towards fulfilling their election promise to Protect public post-secondary educational institutions, such as Laurentian University, from being subject to corporate restructuring.

But we haven’t won the changes we are demanding yet! We need you to be ready to act to ensure that the government doesn’t miss this opportunity to ensure what happened at Laurentian never happens again.

When Laurentian University filed for protection under the Companies’ Creditors Arrangement Act (CCAA) in 2021, it became the first public university in Canada to do so—with devastating consequences for the institution and the Sudbury community. Together, we can make sure it is also the last.

Both the CCAA and Bankruptcy and Insolvency Act (BIA) are federal pieces of legislation specifically designed for private-sector corporations, not public institutions. However, as they are currently worded, these acts can still be used to dismantle and restructure public institutions.

OCUFA and our allies are demanding reform to the CCAA and BIA to ensure they can never again be applied to another public instututions.
